Terms of Service
The short version
- Blocking is free. AI is paid, either by credits or a $9.99/month subscription.
- Credits are prepaid and non-refundable once spent, and they do not expire while your account is open.
- Attentify makes real changes to your computer, including your hosts file and firewall, and can close applications. That is the product working as intended.
- It is a focus tool, not a security product, and a determined user can get around it.
1. Who these terms are with
Attentify is operated by Luca Dominguez ("we", "us"). By downloading, installing or using the Attentify desktop app, browser extension or website, you agree to these terms. If you do not agree, do not use them. Contact: ludomi2502@gmail.com.
2. Your account
You need an account to use Attentify. You must give an accurate email address, keep your password secure, and be at least 16 years old. You are responsible for activity under your account. We may suspend or close accounts that abuse the service, including attempts to claim free trial credit repeatedly across accounts or devices.
3. What the software does to your computer
This matters more than in most software, so we are being explicit. To enforce blocking, the desktop app runs with administrator rights and may:
- edit your hosts file to redirect blocked domains
- add firewall rules
- close running applications you have chosen to block
- change browser policy settings
- stop programs from launching at startup, when you ask it to
- read your browser history, when you ask it to import
The app keeps a change journal and supports system restore points so changes can be undone, and uninstalling is designed to clean up after itself. Even so, you are responsible for deciding whether to grant these permissions on a machine you control and are allowed to modify.
4. Free and paid
Blocking, rules, keyword blocks and local analytics are free. AI features are paid. Every new account receives a small amount of free AI credit once, subject to the anti-abuse checks described in our Privacy Policy.
You can pay in either of two ways:
- Credits, bought in prepaid packs and drawn down as you use AI.
- Subscription, $9.99 per month for AI use subject to fair use. Fair use means we may contact you, and in extreme cases apply limits, if your usage is far outside normal individual use. We will always tell you before limiting anything.
You can also supply your own API key, in which case you pay your provider directly and we do not meter or charge you for AI.
5. Billing, credits and refunds
- Payments are processed by Stripe. Prices are in US dollars and exclude any tax that may apply.
- Subscriptions renew automatically each month until cancelled. You can cancel any time from your account page; access continues to the end of the period you have paid for.
- Credits are prepaid. Unspent credits do not expire while your account is open. Spent credits are not refundable, because the underlying AI cost has already been incurred.
- If you believe you were charged in error, email us within 30 days and we will look into it and refund where fair.
- Where the law gives you a statutory right to cancel or refund, that right applies and nothing here removes it.
- We may change prices. For subscriptions we will give at least 30 days' notice before a change affects you, and you can cancel instead.
When you run out of credit, AI features and adaptive blocking pause. Your rules, keyword blocks and built-in blocking keep working.
6. What we do not promise
Attentify is a focus tool, not a security or parental-control product. It is designed to make distraction inconvenient for someone who wants to be helped, not to be unbeatable. A determined user with administrator access can disable it.
The AI makes judgement calls and will sometimes get them wrong, blocking something you wanted or missing something you did not. Correcting it is part of how it works.
The software is provided "as is". To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that it will be uninterrupted or error free.
7. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, lost data or lost opportunities. Our total liability for any claim relating to Attentify is limited to the greater of the amount you paid us in the 12 months before the claim, or $50.
Nothing here excludes liability that cannot lawfully be excluded, such as for death or personal injury caused by negligence, or for fraud.
8. Acceptable use
Do not use Attentify to break the law, to install it on machines you are not authorised to modify, to resell or redistribute the paid AI service, to work around metering or trial limits, or to attack or overload our infrastructure.
9. Open source
Part of Attentify is published under the MIT licence at github.com/lucadominguez/attentify-open, and your use of that code is governed by that licence rather than these terms. The AI components are not open source and remain our property. These terms grant you a personal, non-exclusive, non-transferable licence to use the software; they do not transfer ownership.
10. Ending things
You can stop using Attentify and delete your account at any time. We may suspend or end your access if you break these terms, or if we discontinue the service. If we discontinue it, we will give reasonable notice and refund any unspent credits.
11. Changes to these terms
We may update these terms. For material changes we will give notice in the app or by email before they take effect. Continuing to use Attentify after that means you accept the new terms.
12. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction. If you are a consumer elsewhere, you keep the protections of your local law.
